Question About Amateur Content

I see a lot of blogs out there posting amateur content (stuff they've found off alt.binary groups and what not) mixed in with their normal affiliate posts. I can see the draw of including this kind of stuff, but aren't they just asking to shoot themselves in the foot with it?

Obviously they don't own the content nor do their affiliates, so I would think that eventually they could be busted for this type of stuff. How do they get around any legal loopholes?
